SpeciesQuest is a personal project, not a company. There is no legal entity, no team, and no commercial backing. Use this Service entirely at your own risk. Data may be lost at any time. The Service may disappear without notice.
1. Nature of This Project
SpeciesQuest is an independent, hobby project created and operated by a single individual ("the Creator"), not a registered company, legal entity, or commercial organisation of any kind. There is no business behind this service. There is no team. There are no employees, investors, or corporate structure. By using SpeciesQuest you acknowledge and accept this fully. Nothing in these Terms of Service should be interpreted as implying the existence of a company, startup, or professional service provider.
2. Acceptance of Terms
By accessing or using SpeciesQuest ("the Game", "the Service") in any way, including browsing the site, creating an account, or observing gameplay, you agree to be bound by these Terms of Service in their entirety. If you do not agree to every part of these terms, you must immediately stop using the Service and delete your account if you have one. The Creator reserves the right to modify these terms at any time without prior notice. Your continued use of the Service after any modification constitutes unconditional acceptance of the revised terms.
3. No Warranties Whatsoever
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ABSOLUTELY NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE CREATOR EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, AND UNINTERRUPTED ACCESS. The Creator makes no warranty that the Service will meet your requirements, be error-free, secure, or available at any specific time. The simulation may produce unexpected results, lose data, or behave incorrectly without notice or recourse.
4. Eligibility
You must be at least 13 years of age to use this Service. By registering, you represent and warrant that you meet this minimum age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and consented to these terms on your behalf. The Creator has no way to verify ages and accepts no liability for misrepresentation.
5. Account Responsibilities
You are solely and entirely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether authorised by you or not. The Creator bears zero responsibility or liability for any loss, damage, or harm arising from your failure to secure your account. You must notify the Creator immediately of any suspected unauthorised access, though such notification confers no obligation to respond, investigate, or remedy the situation.
6. No Guarantee of Service Continuity
The Creator reserves the absolute right to shut down, suspend, modify, or delete the Service at any time, for any reason or no reason, with or without notice. The game world, all species data, all account data, and all progression may be deleted at any moment. You have no right to continuous access, advance notice of shutdown, data recovery, or compensation of any kind if the Service becomes unavailable or ceases to exist permanently. Do not become emotionally or financially dependent on the continued existence of this Service.
7. No Liability for Data Loss
The Creator makes no commitment to maintain backups, data integrity, or data availability. Game data including your species, genome, population history, and rankings may be lost at any time due to technical failure, database issues, hosting problems, or deliberate resets. You agree that the Creator is not liable for any data loss under any circumstances. Do not treat any in-game data as permanent or recoverable.
8. Acceptable Use
You agree not to: (a) exploit bugs or glitches to gain unfair advantage; (b) harass, threaten, or abuse other users; (c) attempt to reverse-engineer, scrape, or extract data from the Service without explicit written permission; (d) attempt to access accounts or infrastructure you are not authorised to access; (e) upload or transmit malicious code; (f) use the Service for any unlawful purpose. The Creator may terminate your access at any time for any violation of these terms, or for any other reason.
9. Intellectual Property
All game content, code, artwork, design, and simulation logic are the property of the Creator. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes only. This licence terminates immediately if you violate any term of this agreement. Nothing in these terms transfers any ownership of intellectual property to you.
10. No Virtual Item Value
Any virtual items, species data, rankings, in-game achievements, or other game constructs have no real-world monetary value and may not be exchanged for money or any other form of compensation. The Creator may modify, remove, or reset all virtual content at any time without obligation to provide notice or compensation.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE CREATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF ENJOYMENT, COST OF SUBSTITUTE SERVICES, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF THE CREATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, the Creator's liability is limited to the maximum extent permitted by law, which in all cases shall not exceed zero dollars ($0.00) as no payment is collected.
12. Indemnification
You agree to defend, indemnify, and hold harmless the Creator from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content you submit or transmit through the Service.
13. Governing Law & Dispute Resolution
These terms are governed by applicable law. Any disputes arising from these terms or your use of the Service shall first be attempted to be resolved informally. If informal resolution fails, disputes shall be resolved by binding arbitration where permitted by law, with each party bearing their own legal costs. You waive any right to participate in class action lawsuits against the Creator. In jurisdictions where arbitration clauses are not enforceable, disputes shall be resolved in the courts of the Creator's jurisdiction.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
